Tax Controversies
- Audits, Claims & Amended Returns -- During the
audit of our client's tax returns, we provide tax representation.
We act as your Power of Attorney (POA) with the Internal Revenue
Service employees as they investigate, examine, and inspection the
client's books and records. We evaluate the tax return for
exposure for over assessments and additional deficiencies. We
assist our client on how to reconstruct records and tax related
information essential to the IRS audit. We review our client's
return for filing Claim for refunds or Amended Returns on
affirmative expenses, deductions, and losses omitted from the tax
return.
- Offers in Compromise (OIC) -- The IRS has the
authority to settle, or compromise, the federal tax liabilities by
accepting less than full payment under certain circumstances. We
evaluate our client's financial circumstances and prepare an OIC -
an agreement between the IRS and our client that satisfies the tax
liabilities outstanding. We consider the best payment terms with
the IRS -- Cash offer ( paid in 90 days or less), Short term
Deferred Payment ( more than 90 days, up to 24 months), or a
Deferred Payment plan (offers with payment term over the remaining
statutory period for collecting the tax).
- Collection Enforcement --We provide affordable
tax representation on collection enforcement actions that involves
levies, liens, and seizures of property. We determine our client's
rights under the full extent of Collection Due Process (CDP)
including audit reconsideration, Taxpayer Advocacy, and litigation
options. Our services extend to Trust Fund Recovery Penalties (TFRP)--
these are tax liability disputes where the IRS determine and
assess a 100% penalty on individuals for funds withheld for taxes
on employees and not paid.
- Appeals -- If our client disagrees with any IRS
proposed audit deficiencies or over assessments; collection
enforcements including OICs, CDPs, or TFRP; or Innocent Spouse
Claims or Audit Reconsiderations, we provide affordable legal
representation that include preparation of a Protest including
conferences, legal research, and settlement considerations. We
represent our client's interest before Appeals Collecting Hearing,
Equivalent Hearing, Reviews, and Audit Conferences. We recommend
settlement offers, collections alternatives, and mediation
strategies.
